Premises Liability

Premises liability occurs when a property owner fails to provide a reasonably safe premises and their failure to do so caused you injuries. To prevail on a premises liability case, the injured person must prove that the property owner failed to meet the standard of care with respect to ownership or maintenance of the property, which caused harm. Suffering an injury alone on someone else’s property does not mean that the property owner was negligent. The existence of an unsafe condition alone does not mean that the property owner was negligent. You must show that the property owner knew or should reasonably have known that the premises was in an unsafe condition, failed to take proper steps to make the premises safe, and that you were injured as a result.

Premises injuries include slip and falls, elevator defects, elevator accidents, swimming pool accidents, inadequate snow or ice removal, insufficient security, icy conditions, fire, explosions, amusement park accidents, insufficient warning signs, inadequate or no lighting, broken stairs, potholes, marina accidents, sidewalk holes, slippery floors, tripping hazards, building code violations, cracking in pavement or floors, loose handrails, no disability access, defective decks, and lack of safety inspections.

If you have suffered an injury at a commercial business or private residence, recoverable damages could include medical costs, lost wages, loss of enjoyment of life, emotional distress, physical impairment, disfigurement, permanent injury, physical pain, and other suffering.
